Information on the protection of personal data pursuant to art. 13 GDPR 679/2016 - "European Regulation on the protection of personal data

Pursuant to art. 13 GDPR 679/2016, Takius srl P.Iva and C.F. 02512690641 with headquarters in Avellino (AV) - Via Carmine Barone, 3 - ZIP 83100, as Data Controller guarantees, within the framework of the regulatory provisions, that the processing of personal data is carried out with respect for the fundamental rights and freedoms, as well as the dignity of the person concerned with particular reference to confidentiality, personal identity, right and protection of personal data. That said, Takius srl informs the interested parties regarding the purposes and methods of processing of personal data collected, their scope of communication and dissemination, as well as the nature of their conferment.

LEGAL BASIS OF THE PROCESSING

Personal data are processed, as better highlighted in the next paragraph, exclusively for purposes related to the activity of Takius srl and the fulfilments related to it; the legal bases can be found in the consent (e.g. for the processing of "special categories of personal data" or for marketing) and/or in the execution of a contract or service of our management to which the user is a party or in the execution of pre-contractual measures taken at the request of the user and/or in fulfilling legal obligations to which the writer Owner is subject and/or in the legitimate interest of the same.

PURPOSE OF PROCESSING

All personal data provided, including any images sent by the interested party, constitute the object of processing and are the result of a free choice of the same: Takius srl has no illicit means to obtain this information. The collection and processing of the personal data in question will be carried out:

i. to answer any questions or for the proper handling of the request made and, if necessary, to provide a response to it and possibly satisfy it also in order to improve the offer of our services.

ii. subject to the manifestation of suitable, free and specific consent, expressible in an optional manner, by the interested party, for purposes such as sending promotional and commercial information, by mail or telephone and/or through electronic communications such as e-mail, fax, messages of the Sms or Mms type or with other automated systems implemented in the future, relating to new offers of products or services proposed by Takius srl.

COMPULSORY AND OPTIONAL NATURE OF THE PROVISION OF DATA AND CONSEQUENCES OF REFUSAL

The provision of personal data and the consequent processing by Takius srl is optional, however, the data marked are strictly functional to the fulfillment of the request of the interested party. Their conferment is necessary for the purposes referred to in paragraph (i) above, any refusal to provide such data or their failure, partial or inaccurate conferment will make it impossible, in whole or in part, to perfect and implement the requests made. The provision of personal data and the consequent processing by Takius srl, for promotional and commercial purposes, is optional and failure to provide such data, even partially, will not have any consequence on the use of services. The use of data is, however, bound, where required by current legislation for the protection of personal data, to the issuance of the appropriate consents by the person concerned, as explained in the relevant paragraph of this information.

METHODS OF PROCESSING

The processing of personal data will be carried out both on paper, by means of manual tools, and with the aid of electronic instruments by means of appropriate computer and telematic procedures, through systems and databases owned by the writer, designed to store, manage and transmit the data, with logics and methods that guarantee security and confidentiality. Takius srl guarantees that the data processed will always be relevant, complete and not excessive in relation to the purposes for which they are collected, with the commitment, on the part of the interested party, to communicate promptly any corrections, additions and / or updates; specific security measures are observed to prevent data loss, illegal or incorrect use and unauthorized access.

RETENTION TIMES

Personal data will be processed for the time strictly necessary to achieve the purposes, described above, to fulfill contractual, legal and regulatory obligations subject to prescriptive and legal terms in respect of rights and in compliance with consequent obligations. With reference to data collected for commercial purposes (referred to in point ii), details are limited - for profiling activity - to 2 years for direct marketing activity. Finally, the site user's personal data may also be retained for as long as permitted by Italian law to protect the legitimate interests of the Owner company (art. 2947, co. 1 and 3 c.c.)."

SCOPE OF KNOWLEDGE OF THE DATA

The processing of personal data shall be carried out, within the limits of the general authorisations issued by the Guarantor for the protection of personal data, by means of subjects expressly and specifically authorised by Takius srl The data may also be processed by third parties (outsourcers), which we use for the provision of services related to the purpose pursued, which our organisation binds with specific contractual clauses or acts of formal appointment as External Data Processors for the processing operations they carry out. In all cases, these subjects will process the data in accordance with the instructions received from the Data Controller, according to the operational profiles attributed to them in relation to the functions performed, limited to what is necessary and instrumental to the performance of specific operations within the scope of the services requested and exclusively for the achievement of the purposes indicated in this information notice. The list of Data Processors, which is constantly updated, can be requested by sending a communication in the manner indicated in the following point concerning the rights of the data subject.

COMMUNICATION AND DISSEMINATION

The data may be communicated, by which term is meant the disclosure of the data to one or more specific parties, in the following terms

to subjects, both public and private, who can access the data by virtue of provisions of the law, regulations or Community legislation, within the limits provided for by these rules (for example, social security and welfare institutions and bodies, associations of local authorities, public administrations and bodies, associations, foundations, associations and/or insurance bodies)

to subjects who need access to the data for purposes auxiliary to the relationship that exists between the parties, to the extent strictly necessary to carry out the auxiliary tasks (for example, banks and credit institutions, service supply companies, carriers and shipping companies)

to our consultants, to the extent necessary to carry out their duties in our organisation, subject to our letter of assignment imposing a duty of confidentiality and security

to companies (providing ancillary services, including IT services), subject to the signing of appropriate contractual clauses imposing the duty of confidentiality and security.

Should such communication not be possible without the free and explicit consent of the data subject, because it is not envisaged in relation to the regulations in force and within the scope of the stated purposes, the expression of consent is indispensable in order to proceed with the communication itself to subjects that perform auxiliary activities with respect to the aforesaid purposes. The data will not be disseminated, by which term is meant giving knowledge to unspecified subjects in any way, even by making them available or consulting them, unless specific, free and informed consent is given for each type of processing.

RIGHTS OF THE DATA SUBJECT

Data subjects, to whom the personal data refer, are entitled at any time to exercise their rights (Right of access to personal data and other rights), in particular: the right to obtain confirmation of the existence or otherwise of their personal data, to access them and to know their content and origin, to verify their accuracy, to request their supplementation or updating, restriction of processing or portability. Rectification and blocking may be requested if the data are incomplete, erroneous or collected in violation of the regulations in force, and it is also possible to oppose their processing for legitimate reasons or any automated decision-making process (including profiling), just as it is also possible to request their deletion for the same reasons, provided that this is done in compliance with the regulations in force and if there are no other obligations for Takius srl to store and process the data; Data subjects also have the right to object to the processing of their personal data for marketing purposes (indicated in point ii), even if carried out using automated contact methods; this right also extends to traditional methods and data subjects may exercise these rights in whole or in part (e.g. only to communications by sms, e-mail or telephone or by opposing only the sending of promotional communications carried out by automated means, etc.). With regard to the exercise of the rights listed above, as well as to know the updated list of the persons responsible for the processing of personal data, the interested party may address his/her requests through specific communication by mail addressed to the same Company, or through the mailbox: web@takius.it, also by sending communication to the e-mail address indicated, in order to obtain a timely reply. Should the data subject have given consent to the processing for a specific purpose, he/she shall always have the right to revoke it at any time without prejudice to the lawfulness of the processing based on the consent given before revocation. It should also be noted that the data subject always has the right to lodge a complaint with the Data Protection Authority in order to exercise his or her rights or for any other matter concerning the processing of his or her personal data.

CONSENT

It should be noted that, in accordance with the GDPR and the provisions of the Garante:

it is not necessary to express consent for the processing of the personal data provided by the data subject for the proper handling of the request made through the "Contacts" section of this website, since such data, which are common personal data, are necessary to respond to an explicit request made by the data subject;

it is necessary, albeit optional, to express one or more specific consents to the processing of the data collected when the Data Controller wishes to use them for its own or third parties' marketing purposes, as specified in the paragraph on purposes. Failure to provide such consent will make it impossible for the Controller to pursue such purposes, but will not have any consequence on the possibility of subscribing to or using the requested service.
